Following the first Art Law Conference at Christie’s in New York in September 2019, Libralex will now bring together art market participants and professionals to discuss current legal issues revolving around art, finance and technology.
Three panels will discuss the impact of NFTs, tokenized artworks and other blockchain applications on the art and art finance markets. The panels will also address questions of provenance research, due diligence, compliance and tax. The keynote speaker is Dirk Boll (Christie’s).

Do Tokens Finally Make an Asset Class Like any Other?
Art has been an investment class for a long time, but it has always been a very special one. Before the art world went “digital” and NFTs as well as tokenized artworks gained traction, fine art was the subject matter of more conventional financial transactions such as art lending. What are the regulatory challenges when offering investments in, or lending against, NFTs vs. more traditional models of art finance? What are the ‘pros’ and ‘cons’ of investing in tokenized art or NFTs from an investor’s perspective? This panel will discuss regulatory issues surrounding NFTs and tokenized art as investment class, including AML and tax issues, and give an overview on investment opportunities relating to the new asset class.

The Provenance of Art. Will Provenance Research and Due Diligence Ever Be Replaced by the Blockchain?
So far, there is no such thing as a central, public register for owners of artworks. Therefore, from a legal as well as from a practical point of view, due diligence regarding the provenance of an artwork is key in order to establish if the seller is the owner and can pass clean title. This can be fastidious and sometimes a ‘mission impossible’. Will this soon change due to blockchain-based applications?
